Unlike criminal matters and the policing of trades and markets, religious courts had no executive powers in matters of family law. Space law is a relatively new field dealing with aspects of international law regarding human activities in Earth orbit and outer space.

So the law ought to pre-empt what would happen, and be guided by the most efficient solution. Coase and others like him wanted a change of approach, to put the burden of proof for positive effects on a government that was intervening in the market, by analysing the costs of action. Investigating, apprehending, charging, and trying suspected offenders is regulated by the law of criminal procedure. The paradigm case of a crime lies in the proof, beyond reasonable doubt, that a person is guilty of two things. First, the accused must commit an act which is deemed by society to be criminal, or actus reus .
